By accessing or using the services provided by Suparena Software Inc. ("Suparena", "we", "us", or "our"), including the iMatch platform, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our services.

2. Description of Service

Suparena provides an integrated sports software platform including video analysis, competition management, digital scoreboard services, and community portal tools for racket sports including tennis, table tennis, pickleball, and badminton.

3. User Accounts

When you create an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4. User Content

You retain ownership of videos and content you upload. By uploading content, you grant Suparena a limited license to process, analyze, and store your content for the purpose of providing our services.

You represent and warrant that:

  • You own or have the right to upload the content
  • Your content does not infringe on any third-party rights
  • Your content complies with all applicable laws
  • You have obtained consent from individuals appearing in your videos

5. Prohibited Uses

You agree not to:

  • Upload content that is illegal, harmful, or violates others' rights
  • Use the service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the service
  • Reverse engineer or attempt to extract our source code or AI models
  • Use automated systems to access the service without permission
  • Resell or redistribute our services without authorization

6. AI-Generated Analysis

Our analysis is generated by artificial intelligence and is provided for informational and training purposes. While we strive for accuracy, AI-generated insights may contain errors or inaccuracies. The analysis should not be considered professional coaching advice, and we recommend consulting with qualified coaches for training decisions.

7. Intellectual Property

The Suparena service, including its design, features, AI models, and content (excluding user-uploaded content), is owned by Suparena Software Inc. and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary materials without written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPARENA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless Suparena and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service, your content, or your violation of these terms.

11. Termination

We may suspend or terminate your access to the service at any time, with or without cause, and with or without notice. Upon termination, your right to use the service will immediately cease. You may delete your account at any time through your account settings.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes by posting the updated terms and changing the "Last updated" date. Continued use of the service after changes constitutes acceptance of the new terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
